HEALTH CARE

We represent hospitals, health plans, physicians and other health care providers in a broad range of legal services. Attorneys in our practice group have extensive experience in health care litigation, regulation, compliance and dispute resolution. We have one registered nurse/attorney and one nurse/paralegal on our staff. We have also developed close working relationships with health care experts in a variety of specialties, both locally and across the country for assistance in our work.

Our legal services in the health care area include a full range of business advising, arbitration, mediation, administrative hearings and trial.

Some of the services we provide to clients in this industry include:

Health Care

  • Representation before the Insurance Division
  • General advice and counseling for Health Maintenance Organizations (HMO), Participating Provider Organizations and Managed Care Plans on statutory and regulatory compliance work involving ADA, ERISA, HIPAA, COBRA, RICO, Medicare, Medicaid, Quest, Patient Bill of Rights, and related programs
  • Assist in obtaining certificates of need and licensure
  • Advise on credentialing, peer review, health care quality issues, medical record-keeping practice, confidentiality, medical bylaws, staff relationships
  • Medical malpractice defense
  • Obtain emergency court orders for health care providers, including for guardianships and emergency treatment issues
  • Advise on matters involving federal and state privacy laws, special classes of information (such as HIV/AIDs, mental health and substance abuse), and common law and statutory privileges
  • Advise health care providers and facilities on medical risk management issues, including medical malpractice, informed consent, EMTALA, Patient Bill of Rights, and confidentiality
  • Assist in internal and external appeals procedures and work with Independent Review Organizations
  • Litigation, arbitration and mediation on a broad range of health plan disputes including coverage, contract claims, participating provider relationships, collections, subrogation liens and reimbursement rights

  • Employment litigation including wrongful termination, discrimination, harassment and retaliation claims
  • Union organizing, collective bargaining negotiations, grievances, arbitration, and proceedings before the National Labor Relations Board

  • Legal analysis of legislative measures, bill tracking and monitoring
  • Obtaining information under the Freedom of Information Act (FOIA) and the Uniform Information Practices Act (UIPA)
  • Representing corporate clients before governmental agencies with regulatory filings involving confidential or proprietary information, and trade secrets

  • Solicitation analysis, proposal and bid preparation
  • Sealed bid procedures, including mistakes in bids and “two-step” sealed bid procedures
